1. Acceptance of Terms
By accessing and using Carlos, the AI-powered car rental search and booking service, you agree to these Terms of Service (TOS), forming a binding agreement between you and Layla AI GmbH. The agreement encompasses related policies and additional terms.

In the event any terms within this TOS contradict the Layla AI GmbH Imprint or Layla AI GmbH Privacy Policy, the terms of the Carlos TOS will control. By accepting these terms, you represent that you have reached the age of majority where you live or reside; otherwise your consent is only valid with the approval of your legal representative, which must be obtained before starting to use our service.
2. Definitions
Service ("Carlos"): The AI-powered car rental search and booking service provided by Layla AI GmbH.
User: Any individual or entity interacting with Carlos.
Rental Company: The car rental supplier that owns the vehicle, operates the pick-up counter and enters into the rental agreement with you.
Data: Information provided by Users or collected during interaction with Carlos.
3. User Conduct and Content
Users must engage with Carlos in a respectful, lawful manner.
Prohibited conduct includes harassment, distributing harmful software, fraudulent activities, or propagating illegal content.
Users are responsible for the accuracy and legality of the content they provide, including the driver details entered at checkout.
4. Third-Party Links and Services
Carlos integrates with third-party services — in particular Expedia Group, which provides the vehicle inventory, availability, rates and booking processing behind the service; the Rental Companies, which fulfil the rental; and Stripe, which processes online payments.

Carlos disclaims responsibility for the practices or content of these third-party services.
5. Bookings, Payment and the Rental Agreement
Role of Carlos: Carlos arranges your car rental booking with the Rental Company through Expedia Group. The rental itself — the vehicle, the pick-up and return, insurance, deposit, fuel, mileage and any extras — is governed by the rental agreement you sign with the Rental Company at the counter and by the Rental Company's terms shown to you before you confirm your booking.
Payment models: depending on the offer, you either pay online at the time of booking (processed by Stripe) or pay the Rental Company at the counter on pick-up. The payment model, the amount charged today and any amount due at the counter are shown before you confirm.
Driver requirements: the driver must meet the Rental Company's requirements shown with the offer, typically a valid driving licence held for a minimum period, a minimum age, a credit card in the driver's name and an identity document. The Rental Company may refuse the vehicle if these are not met at the counter, in which case the Rental Company's terms determine any refund.
Deposits and local charges: the Rental Company may hold a security deposit on the driver's card and may charge locally for optional extras, fuel, additional drivers, young-driver or one-way fees, tolls, fines and damage, as set out in the Rental Company's terms. These charges are between you and the Rental Company.
Cancellation: each offer shows its cancellation terms and any free-cancellation deadline before you confirm. You can cancel from My bookings; refunds, if any, follow the terms shown at booking. Changes to a confirmed booking may be subject to the Rental Company's terms.
Prices: prices are shown in the currency you select and may be converted by your card issuer. The total shown before you confirm is the price that applies to the booking; the Rental Company's local charges are additional.
6. Data Collection and Log Files
Collection Methods: Carlos employs tools like Google Analytics and Microsoft Clarity for data collection. This includes tracking the IP addresses of users to analyze usage patterns, manage the service, and gather broad demographic information for aggregate use.
Purpose and Use: The collection of IP addresses assists in diagnosing server problems, administering the Carlos service, providing services tailored to users' locations and preferences, and — as required by our booking provider — protecting bookings against fraud.
Privacy Compliance: Tracking of IP addresses and other user data will be conducted in compliance with applicable data protection laws. Carlos respects user privacy and the sensitive nature of such data. User consent for data collection and processing will be obtained where required by law, including compliance with GDPR for users in the European Union.
Advertising and Third-Party Integrations: With your consent, Carlos uses advertising and measurement tags from third parties, including Meta (Facebook) and Pinterest. These integrations may also involve data collection practices, including IP address tracking, as governed by the privacy policies of these third-party platforms.
7. Updates and Modifications to TOS
Layla AI GmbH reserves the right to update these TOS. Users will be notified of significant changes through appropriate channels.
Continued use of Carlos after changes constitutes acceptance of the revised TOS.
8. End-User License Agreement (EULA)
Users are granted a limited, non-exclusive, non-transferable license to access Carlos under these TOS.
The license does not extend to Carlos's underlying technology or intellectual property.
9. Feedback and Suggestions
Layla AI GmbH values user feedback but retains the right to determine its utilization.
Feedback provided by users becomes Layla AI GmbH's property without any obligation to the user.
10. Termination of Use
Layla AI GmbH may terminate or restrict a user's access to Carlos for violations of these TOS.
Users may discontinue using Carlos at their discretion. Termination does not affect confirmed bookings, which remain governed by the Rental Company's terms.
11. Limitation of Liability
Layla AI GmbH limits its liability in connection with Carlos to the extent permissible by law.
Liability exclusions include indirect damages and damages arising from third-party integrations, including the performance of the rental itself by the Rental Company.
12. Governing Law and Dispute Resolution
Governing Law: These Terms of Service are primarily governed by the laws of Germany. This jurisdiction will be the baseline for interpreting the TOS and managing any disputes not specifically related to data privacy and retention.
Dispute Resolution: Any disputes arising under these Terms of Service will be resolved through arbitration in Germany, except for disputes relating to data privacy and retention, which may be subject to the jurisdiction of the user's location, as per applicable laws.
Data Privacy and Retention Compliance: While these TOS detail specific requirements for Germany, Layla AI GmbH adheres to the legal standards of data retention and deletion in each user’s jurisdiction, ensuring compliance with the strictest of privacy laws. This means that for matters specifically related to data privacy and retention, the laws of the user's jurisdiction will take precedence, aligning with local legal requirements.
14. Accessibility and Inclusivity
Layla AI GmbH commits to making Carlos accessible to all users, in line with recognized accessibility standards.
15. Additional Provisions
These TOS represent the entire agreement between the User and Layla AI GmbH.
Should any provision of these TOS be deemed unenforceable, the remaining provisions will remain in effect.
Layla AI GmbH may transfer its rights and obligations under these TOS to another entity.
16. AI Output and Contractual Agreements
Carlos's AI-generated search results, summaries and recommendations are provided for information only. Layla AI GmbH makes no claims or warranties as to the accuracy of information generated by the AI, and AI output cannot in any case bind or cause any other person or entity to be bound by contractual terms, with the exception of this TOS and all incorporated terms, including the Layla AI GmbH Privacy Policy and Imprint. This does not affect bookings you complete through Carlos's checkout, which are governed by the booking conditions and the Rental Company's terms shown to you before you confirm your booking.
